New Delhi: The Supreme Court (SC) on Friday issued notice to the Uttar Pradesh government on the petition of Vikas Yadav, son of former Rajya Sabha member D P Yadav, seeking bail in the Nitish Katara murder case.
A Division Bench comprising Justice K G Balakrishnan and Justice Lokeshwar Singh Panta issued the notice returnable within two weeks.
Vikas Yadav has filed an appeal in the Apex Court against the Delhi High Court (HC) order dismissing his bail application.
The HC had dismissed his bail application on the grounds that if he was released on bail, he would certainly influence and pressurise his sister, Bharti Yadav, a key prosecution witness in the case.
Nitish Katara, a son of a senior bureaucrat, was allegedly killed in 2002 as Vikas Yadav and his family were opposed to the relationship between Katara and Bharti.
Vikas has sought bail on the grounds that he had been in jail for the past four years and the trial will take long.
Bharti Yadav, who has not been deposing in the case despite issuance of a non-bailable warrant and initiation of the proceedings for declaring her proclaimed offender, is due to come from London for deposing in the case on November 25 as per the assurance given to the court by her counsel.
