The Uttarakhand High Court has rejected the Centre's plea for adjournment of hearing on the petition challenging imposition of President's rule in the state. The high court has said it won't deal with the budget appropriation issue till the government files its response.
A bench comprising Chief Justice KM Joseph and Justice VK Bisht did not allow the plea of two Additional Solicitors General (ASG), representing the Centre, that the hearing be adjourned as a "completely new case" has been set up by Rawat.
ASGs Tushar Mehta and Maninder Singh sought adjournment on the ground that issue of alleged passage of appropriation bill by the state assembly brings in completely new facts and needed to be responded to as they deal with the root of the case.
Earlier, the Uttarakhand High Court had pulled up the Centre for the imposition of President's Rule in the state. The court said that the floor test is the best method and correct arena to prove majority in state assemblies, adding that President's Rule was imposed despite the state Governor calling for a floor test.
Meanwhile, the Congress, in its affidavit filed in the Uttarakhand High Court on Wednesday, said there is no doubt about the Assembly proceedings on March 18 when the Appropriation Bill was passed by a voice vote.
The Congress also argued that the motion for division of votes or amendment moved were meaningless.
The crucial trust vote in the Uttarakhand Assembly is likely to take place on April 6.
