New Delhi: The Delhi High Court on Monday reserved its order on a plea of RK Chandolia, an accused in the 2G spectrum case and former Private Secretary of prime accused A Raja, against the lower court's decision refusing to direct CBI to produce certain documents related to the case.
A bench of Justice ML Mehta reserved the order after hearing arguments of the probe agency and Chandolia's counsel. The bench also reserved its order on an another plea by the 2G case accused who had challenged the presence of CBI investigating officers (IOs) during the trial.
The counsel, appearing for Chandolia, said Aseervatham Achary, a star prosecution witness in the case, was not a "right witness" and he used to do official works contrary to his claim that he was only resposible for the political works.
"Achary has more knowledge than Chandolia as he used to do official and political works (of Raja)," Chandolia's lawyer said.
The trial court had earlier rejected a plea by Chandolia who had sought records of letters written by Achary to the Department of Telecom (DoT), Information Technology and Post during May 2007 to October 2008.
Chandolia had also sought the record of meetings between Raja and P Chidambaram, the then Finance Minister besides his visit to the ministry and his mobile phone details.
However, it was opposed by CBI which said the documents sought were too voluminous and have no bearing on the case. Besides Chandolia, Kusegaon Fruits and Vegetables Limited Directors Asif Balwa and Rajeev Aggarwal, also accused in the case, have opposed the presence of CBI IOs in the court room during the trial.
