HYDERABAD: Although suspended IAS officer BP Acharya was aware of the fact that the villa plots were being sold by Emaar Town Hills Private Limited (EHTPL) through Stylish Homes real estate, accepting upfront payments from villa buyers without finalising the rate through the Board of EHTPL, Acharya did not raise any objection, the CBI has said. Opposing the bail plea filed by Acharya, the CBI's counsel filed a counter petition in the special CBI court on Friday.In the petition the CBI said that the investigation disclosed that although Acharya had constituted a team of officials comprising consultant C Subba Rao and APIIC deputy general manager (finance) BV Bhaskar Rao to look into the implementation of the integrated project and utilisation of funds with respect to agreements entered into between the APIIC and Emaar Properties of Dubai, and submitted a detailed report to the APIIC on May 11, 2009, he did not initiate any action on the issues pointed out by the committee till he left the APIIC on December 24, 2009.Acharya was a trustee of the property assigned by the APIIC in favour of the respective special purpose vehicle for developing the integrated project.By allowing the SPVs to dispose of the land of the project, without protecting the interests of APIIC, he committed the offence of criminal breach of trust , misappropriation of government property and, thereby, cheated APIIC.“The facts gathered during the course of investigation point to a clear case of criminal conspiracy, criminal breach of trust and abuse of official position by Acharya and accordingly a charge sheet has been filed naming him as accused number one. Investigation in respect of certain issues is still pending. Acharya, being a senior officer of the government, may influence the witnesses,” CBI pleaded.
