New Delhi: A court on Friday dismissed a petition filed by Bharti Yadav, a key witness in the Nitish Katara murder case, that the business executive’s mother be barred from court when she (Bharti) testifies.
The Additional Sessions Judge said Neelam Katara had ''every right'' to know Bharti’s whereabouts and assist the court when Bharti gives her statement.
The court accepted Bharti's demand to depose in-camera. ''It would meet the needs of justice'' to record Bharti's testimony without the media and the public in the courtroom, which is hearing the court every day.
The three-page order said keeping in view the peculiar circumstances of the case and the sensitivity of the matter, it was necessary for the court to ensure that Bharti deposed in an atmosphere which was free of influence or pressure from the media or public.
The court, on November 20, had ruled that the deposition of Bharti Yadav, the daughter of former Rajya Sabha member D P Yadav, would be held in camera on November 29.
Bharti, a student in the United Kingdom, is expected to come to India to depose before the court.
Bharti's brother Vikas Yadav and her cousin Vishal Yadav are accused of murdering Nitish after abducting him from a wedding in Ghaziabad, Uttar Pradesh, in February 2002.
