New Delhi: After facing flak from the family members of Kargil war heroes and the opposition for not approaching the International Court of Justice against the inhuman treatment meted out six Indian Army soldiers during the 1999 Kargil war, External Affairs Minister Sushma Swaraj on Monday evening said that what happened to Captain Saurabh Kalia and five other soldiers of 4 Jat Regiment was unjustified and the Centre will approach the Supreme Court in the case.
"We had an emergency meeting on Captain Saurabh Kalia .So far India and Pakistan have decided that they will not file a case against each other in the International Court of Justice. But in this case what happened to Captain Kalia was unjustified. So we have decided to approach the SC. We shall ask the apex court about what we can do. If they allow us to approach the ICJ, then we shall do so," Swaraj said.
Her statement comes after NDA government faced criticism for its statement that moving the International Court of Justice against Pakistan in the matter is not 'practical'.
Captain Saurabh Kalia, Sepoys Arjunram Baswana, Mula Ram Bidiasar, Naresh Singh Sinsinwar, Bhanwar Lal Bagaria and Bhika Ram Mudh of 4 Jat Regiment were among the first casualties during the 1999 Kargil war.
They were captured by Pakistani troops during a reconnaissance patrol in the treacherous mountainous terrain in May 1999, brutally tortured and killed.
In gross violation of the Geneva Convention the Pakistani Army subjected Captain Kalia and his soldiers to horrendous torture during which the bravehearts’ ear drums were pierced with hot iron rods, eyes punctured and genitals cut off.
The autopsy of the bodies also revealed that they were burned with cigarettes butts. Their limbs were also chopped off, teeth broken and skull fractured during the torture. Even their nose and lips were cut off.
The Pakistani government has maintained that Captain Kalia and his soldiers died due to extreme weather and their bodies were found in a pit.
