Dinakaran defies SC panel, not going on leave
Sources say he is waiting for a formal letter from the Supreme Court Collegium probing him for corruption.

Bangalore: Karnataka High Court Chief Justice PD Dinakaran has continued working in the court despite being asked to go on leave by the Supreme Court Collegium headed by Chief Justice of India KG Balakrishnan.

Sources say Justice Dinakaran is waiting for a formal letter from the Supreme Court Collegium probing him for corruption.

Sources say Justice Dinakaran is yet to receive an official communication from the collegium.

Justice Dinakaran was asked to go on leave following charges of land-grabbing, corruption and abuse of judicial office against him.

Delhi High Court Acting Chief Justice Madan B Lokur has been named as Dinakaran's replacement as the Chief Justice of Karnataka High Court.

Senior advocate Shanti Bhushan said Justice Dinakaran can defy the collegium's advice to go on leave. He said an acting chief justice can only assume charge if the chief justice proceeds on leave.

Dinakaran has been asked to go on an indefinite leave, till a committee investigating all the charges against him completes its enquiry.

The entire process could take almost a year. The 59-year-old Dinakaran has not been performing any judicial work since December last, ever since over 100 Parliamentarians moved the Rajya Sabha Chairman for his impeachment.
