This is on a petition seeking a CBI probe into the mass grave found in 2005.
The bodies of 21 victims, who were allegedly killed in the 2002 post-Godhra riots, were exhumed from Pandarwada in the Panchmahal district of Gujarat in 2005.
Villagers from Panderwada claimed the police buried the bodies instead of handing them over to their relatives.
The Bench headed by Justice B N Aggarwal has now given the state government four weeks to reply.
