Allahabad: A plea of dentist couple Rajesh and Nupur Talwar, challenging the Central Bureau of Investigation decision to file "additional documents" in connection with the murder trial of Aarushi-Hemraj, has been rejected by the Allahabad High Court. The petitioners had claimed that filing of the documents at a stage where "as many as 15 prosecution witnesses stand examined and cross-examined" would "prejudice the accused".
The special CBI court at Ghaziabad had allowed the probe agency to submit the "additional documents". The CBI had said that they wanted to submit some "additional documents", which, they claimed, were "intended to be filed for filling up the lacuna that exists in the prosecution story".
Passing the order on January 24, Justice Sunil Hali observed that the court found "no force in this application" and "accordingly" dismissed the same. The CBI had contended that "no new evidence or documents" were being brought on record.
It said that what was being produced before the trial court was a letter of clarification by a scientist from Centre for DNA fingerprinting and Diagnostics at Hyderabad "that there has been some typographical error in mentioning the description of the exhibits". Aarushi was found murdered inside her room more than four years ago, and hours after the body of domestic help Hemraj was found on the terrace of the Talwars' Noida residence. The case was handed over to the CBI following an outcry over tardy probe by the Uttar Pradesh police.
