Thirteen out of the 15 judges who were compulsorily retired had challenged the order. They sought quashing of the order stating that the grounds were false, no proper explanation was given to them and that the procedure under Karnataka Civil Service Rules had not been followed. In a huge setback to 13 Karnataka judges of civil and senior division cadre, the High Court on Thursday upheld the state government order of compulsorily retirement passed against them in June 23, 2009, based on the recommendations of the then Chief Justice P D Dinakaran.

Dinakaran had recommended to the Governor, to compulsorily retire 15 judges mainly on charges of inefficiency and dereliction of duty. Thirteen out of the 15 judges who were compulsorily retired had challenged the order. They sought quashing of the order stating that the grounds were false, no proper explanation was given to them and that the procedure under Karnataka Civil Service Rules had not been followed. Hearing the petition in January, the High Court ruled it in their favour allowing their petitions and it said that judicial employees can’t be treated like other government employees and set aside the order.

Following this, the state government had filed an appeal challenging the single bench order.

A Division Bench headed by Chief Justice Vikramjit Sen set aside the single bench order and upheld the state government order and disposed of the case.
