Justice Katju alleges former CJI Justice Kapadia of overlooking corruption
Katju alleged former CJI Justice Kapadia of promoting a judge of questionable merit in spite of corruption charges.

New Delhi: Press Council of India Chairman and former Supreme Court judge Justice Markandey Katju has made fresh allegations in his latest blog regarding the promotion of a judge of Allahabad High Court of questionable reputation.

Katju mentions that a certain judge was transferred to the Allahabad High Court after coming under the scanner for corruption. However, with the passage of time he was promoted as the Acting Chief Justice of Allahabad High Court.

Justice Katju in his blog also alleges that former Chief Justice of India SH Kapadia did not ask for the said judge's resignation even after charges of corruption were proved by the report given to Justice Kapadia by Katju, though he did not allow the judge to become Chief Justice of any High Court or a Supreme Court judge.

In his blog, Justice Katju writes, "Most Chief Justices of India are reluctant to expose corruption in the judiciary thinking that this will defame the judiciary, and so they prefer to bury corruption under the carpet, not realizing that the bulge under the carpet will show."

Justice Katju had recently made another allegation of corruption in the judiciary. Katju had alleged that a District Judge in Tamil Nadu was elevated to an Additional Judge of the Madras High Court despite charges of corruption against him.

Katju alleged that the tainted judge had been directly appointed as a District Judge in Tamil Nadu and during his career as the district judge, there were as many as eight adverse entries against him recorded by various portfolio judges of the Madras High Court.

Katju has alleged that one acting Chief Justice of the Madras High Court, by a single stroke of his pen, deleted all those adverse entries and consequently he became an Additional Judge of the High Court. He has said that the corrupt judge had solid support of a very important political leader of Tamil Nadu.

Katju said that former CJI RC Lahoti made a compromise by allowing the corrupt judge to continue despite the adverse Intelligence Bureau report against him. Justice Lahoti denied the claims saying, "Everything is a matter of record. Whatever I have done or not done is all on record with reasons. I have never done anything wrong in my life."

This was when the UPA was in power with the DMK, its ally, in power in Tamil Nadu. "This is a glaring example of political interference in the appointment of judges," Katju said.

Katju also alleged that the former Chief Justices of India allowed the tainted judge to continue despite complaints against him.

Katju said that as a judge was elevated to the High Court while being a District Judge, he had granted bail to that political leader.BLUR_B
