Immigration Minister Rita Verdonk was ordered to re-examine the case of the Feyernoord player by the country's highest legal body which does not deal with criminal or civil cases.
Up till that point, Verdoonk had refused to accelerate the immigration process because the 20-year-old had only lived in the Netherlands for two years instead of the mandatory five.
Holland coach Marco van Basten has said Kalou would be in his World Cup squad if he was given a Dutch passport.
