BANGALORE: For the first time in the history of Karnataka, a former chief minister and his kin stood in the accused box of a court.This happened on Monday as B S Yeddyurappa, his two sons (one an MP), son-in-law and others appeared at the Lokayukta Special Court in response to a summons related to two PC (Prevention of Corruption Act) ACT cases.Judge Sudheendra Rao adjourned the hearing on the bail application to September 7.Yeddyurappa, his sons MP B Y Raghavendra and B Y Vijayendra, son-in-law Sohan Kumar, former minister Krishnaiah Shetty, MLA D Hemachandra Sagar appeared in the box along with other accused.Advocates for Yeddyurappa, Ravi B Naik and C V Nagesh, insisted that they were ready to argue on the bail application, but the judge did not agree.Yeddyurappa and others are facing charges of illegal de-notification of lands.BSY is accused number one in the private case filed by Sirajuddin Basha in two out of five cases.Earlier, both Ravi Naik and C V Nagesh urged the court to appoint a Special Public Prosecutor (SPP) for the case, objecting to the representation of CH Hanumantharaya, who is arguing behalf of Sirajuddin Basha.Both Nagesh and Naik contended that there is no need for an advocate since the case is between the state v/s Yeddyurappa and others.Countering the argument, Hanumantharaya said that the case has been filed as PCR (private complaint register) and hence he is representing Basha.Hearing both the arguments, the court asked the counsel of the accused to serve the bail application copy to the counsel of Basha and the Public Prosecutor of Lokayukta.Judge Sudheendra Rao said that after studying citations and judgments of various courts, he will rule on whether to have a public prosecutor or not.Ten accused in the third case filed by Basha, including Yeddyurappa, Raghavendra, Vijayendra, Sohan Kumar, MLA Hemachandra Sagar, former minister Krishnaiah Setty were present.The bail application was also filed by 14 accused, in the second case filed by Basha.The 14 accused were summoned on August 8 to be present before the court on August 27.But after verifying BSY’s plea on his health grounds, the court asked the accused to be personally present on August 29.In the second case, the court summoned the accused to be present on the same date.On Monday, the court adjourned the hearing to the afternoon as the counsels of Yeddyurappa requested that the accused in two cases appear in the afternoon.While Yeddyurappa and his sons came out of the packed court hall, people began shouting ‘shame shame Yeddyurappa.’ But an unperturbed Yeddyurappa zoomed away with his family members amidst tight police security.The court started its hearing at 3 pm and the accused were present on time.All the accused have filed bail applications.When BSY left the court, in his usual style he exhibited the victory symbol.But he looked humble inside the court when all eyes in the jam-packed court hall were on him.He stood in the accused box for 45 minutes with the co-accused and seemed upset as the HC had rejected his bail plea.His counsels applied in another CrPC section to avail bail.

Anita’s pleasBANGALORE: The High Court on Monday adjourned a petition filed by former chief minister H D Kumaraswamy and his wife Anita seeking to quash the lower court’s proceedings against them following a private complaint before the special court.The single bench of Justice K N Keshavanarayan will resume hearing on Tuesday morning.Vinod Kumar, an advocate, has alleged in his private complaint that Kumaraswamy had violated norms while renewing the mining license of Jantakal Mining Company during his tenure as CM and also made bulk allotment of land to Viswabharathi Housing Cooperative Society.The society, as a quid-pro quo deal, is said to have allotted a site to Anita.Appearing for Kumaraswamy and Anita, advocate Hasmath Pasha argued that the lower court has issued summons based on incomplete recording of sworn statement of the complainant

Bail plea in Datta case adjournedBANGALORE: The High Court on Monday adjourned another anticipatory bail petition of former chief minister B S Yeddyurappa relating to a private compliant filed by JD (S) leader Y S V Datta, alleging him of committing irregularities while allotting tenders in the Upper Bhadra project, till September 5.The court adjourned the plea after Yeddyurappa’s advocate sought one week’s time.Initially, the advocate sought two weeks time to which the court objected and later adjourned the petition by one week.Datta alleged that the project was awarded to the highest bidder, a private firm RNS Jyothi, at `1,033 crore, contrary to the norm, as in the case of a government project it is the lowest bidder who gets the contract.
