The TN Bench of the Central Administrative Tribunal (CAT) has directed the Union Ministry of Finance to promote V Sreenivasan, Assistant Commissioner, Central Excise Commissionerate-I in Nungambakkam, as Deputy Commissioner with all consequential benefits.

The TN Bench of the Central Administrative Tribunal (CAT) has directed the Union Ministry of Finance to promote V Sreenivasan, Assistant Commissioner, Central Excise Commissionerate-I in Nungambakkam, as Deputy Commissioner with all consequential benefits.

The Tribunal comprising judicial member G Shanthappa and administrative member R Satapathy gave the direction, allowing an application from Sreenivasan, on August 22 last.

As two departmental proceedings were pending against Sreenivasan, he was denied promotion. Advocate M Ravi contended that the initiation of the departmental proceedings could not be made an impediment against the applicant and as such, he was eligible for promotion as Deputy Commissioner from 2006. The proceedings, initiated against Sreenivasan after three yearsof eligibility for promotion, which were under challenge on the file of this Tribunal, could not be made  an impediment for applicant’s entitlement for the relief sought for in this application, Ravi added.

The Tribunal pointed out that at the time of promotion due in 2006, no proceedings had been pending against the applicant.

The charge memo was issued to him only in 2009 and that would not come in the way for consideration for promotion to the post of Deputy Commissioner.
