New Delhi: The turf war between the Aam Aadmi Party and the Central Government has reached the courts. The former has moved the Delhi High Court while the latter has knocked the doors of the Supreme Court. The apex court will hear the Centre's plea on Friday challenging Delhi HC order that said that L-G has no power in posting and transfer of bureaucrats.
AAP government, too, has challenged in Delhi High Court the Centre's notification which gives L-G absolute powers in appointing bureaucrats. The Delhi HC will hear the AAP's plea against the Home Ministry notification on Friday.
After the Delhi High Court termed the Home Ministry notification on Lieutenant Governor's powers as suspect, the Centre moved the Supreme Court via a Special Leave Petition. The Centre has claimed that the order has left the equation between the L-G and Delhi government in 'total uncertainty'.
The Home Ministry notification had curtailed the jurisdiction of the Anti-Corruption Branch of Delhi saying it cannot act against officers of the Central government.
Enraged by the notification, the AAP government called for a special session of the Delhi Assembly and passed a resolution calling the notification unconstitutional and an illegal exercise of power.
In the resolution, the Assembly called the Home Ministry's notification an attempt to "encroach upon" the legislative powers of the House conferred by the Constitution and said it was "completely unconstitutional, illegal and invalid".
Just before the House adopted the resolution, Kejriwal in his fiery address lambasted Lt Governor Najeeb Jung who he said was "dancing to the tune" of the Centre and "deliberately" trying to create obstacles for the AAP government.
"Whatever is happening in Delhi is dangerous. This is the Delhi experiment of the BJP-led Centre. One by one, this experiment would be implemented in every non-BJP state. They want to take the country towards dictatorship. I appeal to all non-BJP chief ministers to come together and unite on this issue," he said.
