CHENNAI: A litigant, who misused the concept of public interest litigation (PIL) for personal gain, was slapped with a cost of Rs 2 lakh by the Madras High Court on Monday.
"This is one of the instances, which will show the concept of PIL, which is meant for giving relief to the poor and downtrodden, is being misused, not only in this case, but also in the entire State of Tamil Nadu,' the first bench comprising Chief Justice M Y Eqbal and Justice T S Sivagnanam observed. The cost should be paid to the TN State Legal Serices Authority within two weeks, the bench said.S Boopathy filed the PIL praying for a direction to the authorities concerned to evict V Kanagam and K Asaithambi from the Odai poromboke land of 1.73 acres at Kattukottai village in Salem district.

The petitioner alleged that the duo had obtained electricity connection and permission for other facilities with the connivance of the authorities concerned for running a sago factory.

It was the petitioner who got the electricity supply and other permissions, they added.

"We totally deprecate the conduct of the petitioner in filing the petition as PIL. We have no hesitation in dismissing the petition by imposing the cost of Rs 2 lakh...,' the bench said.
