A writ petition seeking to quash the consent order dated July 23 this year of the Tamil Nadu Pollution Control Board (TNPCB) to commence the first two units in the Koodankulam Power Plant in Tirunelveli district, was closed by the Madras High Court on Wednesday.
“Since the TNPCB has issued a fresh consent order dated August 22 last, giving various particulars, a copy of which has also been handed over to counsel for petitioner (G Sundarrajan), the writ petition stands closed in terms of the said consent order,’’ a divison bench comprising Justices P Jyothimani and P Devadass said.
In its August 22 consent order, granted under Sections 25 of the Water (Prevention and Control of Pollution) Act, the PCB had stipulated a new set of general and specific conditions with regard to discharge of effluents. The consent, valid till March 31, 2013, was for the production of 2,000 MW. Any change in the quantity or quality had to be brought to its notice and fresh consent had to be obtained, the order stated. The bench is likely to pass its orders on the batch of writ petitions challenging the commissioning of the entire project, on Friday.
