BANGALORE: The Lokayukta Special Court has expressed its dissatisfaction with former CM H D Kumaraswamy and his wife Anita Kumaraswamy for taking the court proceedings lightly in the case under the Prevention of Corruption Act and posted the hearing to September 9.Kumaraswamy is facing the charges of giving mining lease to the Jantakkal Mining Company and allotting land to Vishwabharathi Cooperative Society. In the second case, his wife Anita was allotted a site in her name.Judge Sudheendra Rao expressed displeasure on both the accused as they absented themselves from the court proceedings for the second time on health grounds.“It is not possible to give exemption every time citing health reasons. The court has lots of work and it is impossible to post the case every time,” the judge observed on Wednesday.When the judge asked the counsel of the accused, Azmath Pasha, about their absence, the advocates requested him to grant exemption again as the HC was hearing their anticipatory bail petition. To this, the judge said, “I will give again extra half an hour, and the accused have to clarify whether they would appear in the court or not. Or please file an application for exemption again and I will take a decision accordingly.” When the court started hearing at 12 noon, the HDK couple did not turn up. An irritated judge then said the court would not tolerate such attitude. “I am ready to adjourn the case till 5pm, but the same should not be repeated,” he said. R N Patil, counsel for complainant Vinod Kumar, said Kumaraswamy was healthy, but avoided the court proceedings by giving false reasons. Pasha brought to the attention of the court the HC’s decision to grant one-day exemption to Kumaraswamy and his wife.The judge again posted the hearing to 3pm and Patil submitted a CD of the controversial statement made by Azmath Pasha to the court.
